1. Agreement to Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you and UNSHAKEN BIRTH LLC (“Unshaken Birth,” “we,” “us,” or “our”) governing your access to and use of www.unshakenbirth.com and any related content, course portal, community forum, or services (collectively, the “Services”).​

By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Services.​

You represent that you are at least 18 years of age and are using the Services for personal, non‑commercial purposes related to education and self‑development

2. About Unshaken Birth and the Services

Unshaken Birth provides educational information and resources designed to help women build mental‑health‑supportive skills, communication strategies, and boundary‑setting skills related to pregnancy, labor, birth, and the postpartum period. The Services may include:​

  • An informational website and blog

  • Online courses with pre-recorded lessons, downloadable materials, and live online teaching sessions

  • A private student portal and community forum for participating users

  • Optional group or individual sessions, including faith-based offerings and sessions provided in exchange for voluntary donations to third-party nonprofits

We may update, expand, or modify the Services from time to time in our sole discretion.

3. Not Therapy, Not Medical Care

The Services are educational and informational only. They are not psychotherapy, counseling, medical care, or a substitute for individualized professional treatment.​

  • No therapist‑client, counselor‑client, doctor‑patient, or other professional relationship is created between you and Unshaken Birth, or between you and any instructor, by your use of the Services.​

  • The Services do not provide diagnosis, treatment, or medical advice for any physical or mental health condition.​

  • You should always consult your own physician, midwife, therapist, or other qualified professional regarding your specific medical and mental health needs.​

If at any time you experience significant distress, thoughts of self‑harm, or signs of mental health crisis, you agree to seek immediate help from appropriate emergency or professional resources in your area.

4. Conflict of Interest and Client Status

The Services are intended for individuals who are not current therapy clients of the owner or any clinician operating through Unshaken Birth in a psychotherapist role, and who do not plan to enter into such a therapeutic relationship in the near future.​

By using the Services, you represent and warrant that:

  • You are not currently in an individual psychotherapy or counseling relationship with the owner of Unshaken Birth, LLC, and​

  • You do not intend to initiate such a therapeutic relationship within at least six (6) months after completing any course, coaching, or group experience provided through Unshaken Birth, unless specifically approved in writing and in compliance with applicable professional ethics rules in your jurisdiction.

If you are or become a therapy client of the owner or an affiliated clinician, you agree to disclose that relationship before enrolling in any course or other Service, and we reserve the right to deny or terminate your access to avoid dual‑relationship and conflict‑of‑interest concerns.

5. No Professional-Client Relationship

Participation in courses, live sessions, community forums, or 1:1 educational calls does not create:​

  • A therapist‑client relationship​

  • A doctor‑patient relationship

  • A nurse‑patient, midwife‑client, or any other licensed professional‑client relationship

Any general information shared in live calls, Q&A sessions, videos, forums, or downloadable materials is for educational purposes only and is not tailored as professional advice for your specific situation.​

6. User Eligibility and Account Registration

To access certain features (such as the student portal, course content, or community forum), you may need to create an account and provide accurate and complete information. You agree to:

  • Maintain the security of your login credentials​

  • Promptly update your account information as needed

  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms or are using the Services in a way that could harm others or our business.​

7. Payments, Refunds, and Cancellations

7.1 Payments

Paid offerings may include online courses, live teaching series, and optional 1:1 sessions or upgrades. You agree to pay all fees associated with your chosen offering at the time of purchase, using a valid payment method.​

Prices are listed in U.S. dollars and may be changed at any time, but price changes will not apply retroactively to completed purchases.​

7.2 Refund Policy

Unless otherwise stated at checkout or in a specific program description:

  • You may request a full refund for any reason within fourteen (14) days of your initial purchase of a course or paid program.

  • To request a refund, you must contact us at [email protected] within that 14‑day window, including your full name, email, and details of the purchase.

  • After the 14‑day period, all fees are non‑refundable.

For any separate 1:1 educational sessions or upgrades, cancellation and rescheduling terms may be set out in additional program‑specific policies. If such policies conflict with this section, the more specific terms will govern.​

7.3 Donations in Lieu of Payment

From time to time, we may offer free sessions to Christians or other groups where suggested access is linked to voluntary donations to third‑party nonprofits. In those cases:​

  • Donations are made directly to the nonprofit (not to Unshaken Birth, LLC).

  • Proof of donation is not required for access unless explicitly stated.

  • Access to the Service is not contingent on making any donation.

Unshaken Birth, LLC is not responsible for tax treatment or other consequences of your donations to third parties.

8. License and Intellectual Property

All content provided through the Services—including videos, written materials, audio, images, and downloadable PDFs—is owned by or licensed to Unshaken Birth, LLC and is protected by copyright and other intellectual property laws.​

Subject to your compliance with these Terms and payment of any applicable fees, Unshaken Birth grants you a limited, non‑exclusive, non‑transferable license to access and use the content for your personal, non‑commercial use only. You agree not to:​

  • Copy, reproduce, distribute, or publicly display course materials or portal content except as expressly allowed

  • Share login credentials or allow others to access paid content using your account

  • Create derivative works or offer any of the content as your own program or product

9. Community Forum and User Conduct

If you participate in any community forum, chat, or group space associated with the Services, you agree to:​

  • Treat others with respect and avoid harassment, hate speech, or abusive behavior

  • Not share confidential or identifying details about other participants

  • Avoid giving medical or mental health advice to others, including diagnosing or prescribing

You are solely responsible for your interactions and the content you post. We may monitor, edit, or remove content that violates these Terms or that we consider harmful, offensive, or inappropriate.​

10. Prohibited Activities

In using the Services, you agree not to:​

  • Use the Services for any unlawful purpose

  • Interfere with or disrupt the functioning or security of the website, portal, or forum

  • Attempt to gain unauthorized access to any part of the Services or related systems

  • Use automated tools (such as bots or scrapers) to access or copy content

  • Reverse engineer or attempt to derive source code from any software used in the Services

We may terminate or restrict your access if we believe, in our discretion, that you have engaged in prohibited activity.​

11. Testimonials and Use of Participant Content

11.1 Participant Content You Share

“Participant Content” means any comments, feedback, posts, messages, reviews, survey responses, or other material you share with us or other users through the Services, including during live sessions, in the community forum, and via email or other written communication about your experience with Unshaken Birth.​

You remain the owner of your Participant Content, but by submitting or sharing Participant Content in connection with the Services, you grant Unshaken Birth, LLC a worldwide, royalty‑free, perpetual, irrevocable, non‑exclusive, transferable license to use, reproduce, adapt, publish, translate, create derivative works from, distribute, and display such Participant Content, in whole or in part, in any media now known or later developed, for the purposes of operating, improving, and promoting the Services and our business, including testimonials and marketing.​

11.2 Testimonials and Marketing Use

You agree that we may use your Participant Content as testimonials or illustrative examples of participant experiences on our website, in social media, in presentations, and in other marketing or educational materials, subject to the following:

  • If we use direct quotes, we will generally use first name and last initial or a descriptive label (for example, “course participant”) unless you give explicit permission to use your full name.

  • We may lightly edit your comments for length, clarity, or grammar, while preserving the original meaning.

  • We will not intentionally share details that are reasonably likely to identify your medical or mental health status or other sensitive personal information without your explicit permission.

If at any time you wish to withdraw permission for future use of a specific testimonial that identifies you, you may contact us at [email protected]. We will make reasonable efforts to stop using that testimonial going forward, but we cannot fully remove it from materials already printed, published, or distributed.​

You understand that we are not obligated to use any Participant Content and that we may remove or decline to publish Participant Content at our discretion.​

12. Testimonials and Results Disclaimer

From time to time, we may share stories, testimonials, or examples of participants who have improved their communication skills, boundary‑setting, or experiences around pregnancy and birth. Any such examples represent individual experiences only.​

  • Individual results will vary, and there is no guarantee that you will achieve similar outcomes.

  • Outcomes depend on many factors, including your personal circumstances, medical and mental health needs, and the care you receive from your own providers.​

13. No Guarantees Regarding Medical, Mental Health, or Birth Outcomes

Unshaken Birth does not and cannot guarantee:​

  • Specific mental health outcomes

  • Particular birth outcomes or obstetric decisions

  • Prevention of trauma or distress during pregnancy, labor, birth, or postpartum

You remain fully responsible for your decisions, including decisions about your health care providers, birth setting, and interventions.​

14. Third-Party Links and Resources

The Services may reference or link to third‑party websites, services, or resources (including nonprofits for donations). These third parties are not under our control, and we are not responsible for their content, policies, or practices. You access third‑party resources at your own risk.​​

15. Disclaimers

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.​

We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non‑infringement, and any warranties arising out of course of dealing or usage of trade.​

We do not warrant that the Services will be uninterrupted, error‑free, or free of harmful components, or that any defects will be corrected

16. Limitation of Liability

To the maximum extent allowed by law, in no event shall Unshaken Birth, LLC or its owners, members, employees, or contractors be liable for:​

  • Any indirect, incidental, consequential, special, or punitive damages

  • Any loss of profits, revenues, data, goodwill, or other intangible losses arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.​

Our total aggregate liability to you for any claim arising out of or relating to the Services or these Terms shall not exceed the amount you paid to us for the applicable Service in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (100 USD), whichever is greater, to the extent permitted by law.​

Some jurisdictions do not allow limitations of certain damages; in those cases, the limitations above may not apply to you.​

17. Indemnification

You agree to indemnify, defend, and hold harmless Unshaken Birth, LLC and its owners, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:​:

  • Your access to or use of the Services

  • Your violation of these Terms

  • Your participation in any community forum or live session

  • Your reliance on any information obtained through the Services

18. Governing Law and Jurisdiction

These Terms and your use of the Services are governed by the laws of the Commonwealth of Virginia, without regard to its conflict‑of‑law principles.​

You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.​

Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Services.​
